As of Monday, February 25, it will be mandatory for all judges in the country to grant extraordinary constitutional appeals to those who wish to smoke marijuana.

The Supreme Court of Justice of the Nation (SCJN) published in the Judicial Weekly of the Federation eight theses of jurisprudence on the recreational use of marijuana, in which it determined that its prohibition is unconstitutional.

The ministers of the First Chamber of the SCJN pointed out that the prohibition of the use of marijuana is not a proportional measure to protect the health and public order. In this sense, they indicated that the penalty violates the free development of the personality.

However, the resolution of the highest court of justice in the country does not include the production or trade of marijuana since there is still no position on the matter.

Is it illegal to smoke marijuana in Mexico?

The eight theses of the Supreme Court of Justice of the Nation are the following:

1. An absolute prohibition is not a proportional measure to protect the health and public order.

2. Absolute prohibition of marijuana for constitutionally valid purposes.

3. Unconstitutionality of the absolute prohibition.

4. Rights of third parties and public order.

5. Right to health protection.

6, 7 and 8. Right to the free development of personality in different topics.
